1. Image Usage Rights
1.1 By booking with Owen Howlett Media, you agree that the photographer retains the right to use any and all photographs captured during your booking for promotional and marketing purposes.
1.2 This includes, but is not limited to:
1.2.1 Social Media – Images may be shared on platforms such as Instagram, Facebook, TikTok, Pinterest, and others to showcase the photographer’s work.
1.2.2 Website Use – Images may appear on www.owenhowlettmedia.com or associated pages as part of the photographer’s portfolio or blog.
1.2.3 Printed Materials – Selected photos may be used for printed marketing such as business cards, flyers, brochures, banners, or exhibition displays.
1.2.4 Commercial Promotion – Images may be included in advertisements, submissions to publications, collaborative projects, or future promotional campaigns.
1.3 Unless otherwise agreed in writing before the booking, Owen Howlett Media reserves the right to use images from any shoot including weddings, corporate events, festivals, private functions, and commercial projects for the purposes outlined above.
2. Copyright and Ownership
2.1 All images taken by Owen Howlett Media are protected under UK copyright law.
2.2 This means:
2.2.1 Owen Howlett retains full copyright ownership of all images produced.
2.2.2 Clients receive a non-exclusive, non-transferable license to use the images for personal or agreed business purposes only.
2.2.3 Images may not be altered, edited, sold, or distributed to third parties for commercial use without written consent from the photographer.
2.2.4 If commercial rights or full copyright ownership is required, a separate licensing agreement must be arranged and may involve additional fees.
3. Release and Consent
3.1 By booking a service with Owen Howlett Media, you grant permission for your likeness and that of any guests, participants, or attendees photographed to be used for promotional purposes as outlined in Section 1.
3.2 This applies to all types of bookings including, but not limited to, weddings, corporate events, music festivals, private parties, and commercial shoots.
3.3 No financial compensation will be provided for the use of these images unless agreed in writing prior to the event.
3.4 For participants under the age of 18, the client is responsible for obtaining parental or guardian consent where necessary.
3.5 If you have specific restrictions on image use, these must be communicated in writing before the booking.
4. Privacy and Opt-Out Clause
4.1 We respect client privacy and will make reasonable efforts to accommodate requests not to share certain images publicly.
4.2 If you would like your images to:
4.2.1 Not be shared on social media
4.2.2 Not be used for advertising or public display
4.2.3 Only be shared with your direct approval
4.3 These requests must be made in writing before the booking date. Requests made after delivery will be considered but cannot be guaranteed once images are published.
5. Payment Terms
5.1 A non-refundable deposit of 50% of the total booking cost is required at the time of booking to secure the date.
5.2 The remaining 50% balance must be paid in full no later than 14 calendar days before the event date.
5.3 If the balance is not paid by this date, Owen Howlett Media reserves the right to cancel the booking. The deposit will be forfeited.
5.4 Payments made after the due date may incur a late payment charge of 10% of the total booking cost.
5.5 Payments can be made via bank transfer, PayPal, or any other method agreed at the time of booking. Payment details will be provided after confirmation.
6. Cancellation & Rescheduling Policy
6.1 All deposits are strictly non-refundable.
6.2 Cancellations made 14 days or more before the event date: clients will forfeit the deposit, but any remaining balance (if already paid) will be refunded.
6.3 Cancellations made less than 14 days before the event date (including on the day of the event): clients remain liable for the full booking cost. No refunds will be issued.
6.4 No-shows without prior notice will be charged at the full booking cost.
6.5 If a client wishes to reschedule or move the event date, this will only be possible if the photographer is available on the new date and an admin fee of £300 will be charged. The deposit will be transferred to the new booking, but the new date is not confirmed until the admin fee has been paid in full.
6.6 In exceptional circumstances (e.g. illness, emergencies), alternative arrangements may be offered at the photographer’s discretion.
7. Professional Representation
7.1 Owen Howlett Media is committed to representing all clients professionally, respectfully, and accurately.
7.2 Images will never be used in a way that could be considered offensive, misleading, defamatory, or damaging to your personal or professional reputation.
7.3 All work will be delivered with a focus on quality, authenticity, and creativity.
8. Liability and Indemnity
8.1 Owen Howlett Media will take the utmost care during all bookings; however, in the unlikely event of equipment failure, loss, theft, or unforeseen circumstances beyond control, liability is limited to a full refund of payments made.
8.2 The photographer is not liable for delays or missed images caused by circumstances outside their control, including but not limited to: late arrival of clients, weather conditions, venue restrictions, or event schedule changes.
9. Force Majeure (Unforeseen Circumstances)
9.1 If an event beyond the photographer’s control (e.g. illness, accident, natural disaster, or government restrictions) prevents the fulfilment of the booking, Owen Howlett Media will offer to reschedule or refund payments made, excluding the non-refundable deposit.
10. Client Responsibilities
10.1 Clients must ensure they and/or their guests are ready and available at the agreed times.
10.2 If a client or event runs late, this may reduce the coverage time and number of images provided.
10.3 The client must communicate any specific shots, requests, or key individuals to be photographed in advance.
11. Editing and Delivery
11.1 Edited images will be delivered within 14 days of the event date unless otherwise agreed in writing.
11.2 Editing includes standard colour correction, cropping, and light retouching.
11.3 Additional editing requests beyond the agreed style may incur extra charges.
11.4 The photographer retains full artistic discretion over editing style and final image selection.
12. Model Release for Third Parties
12.1 If third parties such as brands, venues, collaborators, or sponsors wish to use images for commercial purposes, they must obtain written permission from Owen Howlett Media before use.
13. Confidentiality
13.1 Owen Howlett Media will not share any personal or sensitive client information without consent.
13.2 Clients agree not to share unedited or raw images publicly without written permission from Owen Howlett Media.
14. Drone Photography & Weather Conditions
14.1 Drone photography and videography are subject to UK Civil Aviation Authority (CAA) regulations, venue permissions, and weather conditions. Owen Howlett Media reserves the right to cancel or amend aerial work if it cannot be carried out safely or legally.
14.2 The use of drones is dependent on:
14.2.1 Suitable weather conditions (e.g., low wind, no heavy rain, adequate light).
14.2.2 Safe flying environments free from hazards such as crowds, restricted zones, or overhead obstructions.
14.2.3 Permissions from the relevant landowners, event organisers, or authorities where required.
14.3 In the event that drone work cannot proceed due to adverse weather, unsafe conditions, or legal restrictions, no refunds will be issued for the photography/videography booking as a whole. However, Owen Howlett Media will make reasonable efforts to reschedule the aerial portion or provide alternative ground-based coverage.
14.4 The decision to fly the drone rests solely with the photographer and is based on safety, legal requirements, and operational risk assessment.
14.5 Owen Howlett Media is not liable for missed aerial shots caused by weather, restricted airspace, or venue refusal.
15. Travel & Accommodation Costs
15.1 For bookings outside the photographer’s local area, travel expenses (including mileage at £0.45 per mile) and reasonable accommodation costs, where applicable, will be charged to the client.
15.2 These costs will be agreed in advance where possible and invoiced accordingly.
16. Overtime & Extended Coverage
16.1 Bookings are based on the agreed coverage time stated in the contract or booking confirmation.
16.2 If coverage is required beyond this time, additional hours will be charged at £175 per hour (or part thereof), payable within 7 days of invoicing.
17. Food & Breaks for Long Events
17.1 For bookings lasting 6 hours or more, the client must provide a suitable meal and reasonable break periods for the photographer and any assistants.
17.2 Breaks will be scheduled to avoid missing key moments but are necessary for safe and effective working.
18. Archiving of Images
18.1 Final edited images will be stored by Owen Howlett Media for a maximum of 6 months after delivery.
18.2 After this period, files will be permanently deleted, and Owen Howlett Media will have no responsibility for retaining them.
18.3 Clients are advised to download and securely back up their files upon receipt.
19. RAW File Policy
19.1 Unedited RAW image files are not released to clients as standard.
19.2 RAW files may only be provided if agreed in writing before the booking, and additional fees may apply.
19.3 The photographer retains all rights to the RAW files even if copies are provided to the client.
